ALBANY A former General Electric Co. physicist who says he was fired for blowing the whistle about potential radiation contamination in Niskayuna will have a chance to tell his story to the state's highest court.
The Court of Appeals agreed Tuesday to decide whether Frank L. Bordell can pursue a whistle-blower lawsuit against GE. Two lower courts barred the suit after finding that Bordell failed to meet technical requirements of state labor law.
Bordell, who formerly worked at the Knolls Atomic Power Laboratory in Niskayuna, claimed in a $10 million lawsuit that he was fired after telling the U.S. Department of Energy that 400 laboratory workers could have been subjected to radiation overexposure.
GE disputed the claims, produced reports indicating its operations were clean and fired Bordell. The company claims it fired him for insubordination and falsifying records.
Bordell, now living in Needles, Calif., brought a whistle-blower action and a defamation suit. The defamation suit was resolved for undisclosed terms.
